Justice Torkonoo Can’t Sit On My Case – Dery Tells CJ

Justice Paul Dery continues to fight the legal system for a fair hearing, in the alleged judicial corruption scandal in which he was implicated.

The embattled High Court judge this time has petitioned the Chief Justice to remove Justice Gertrude Torkonoo from all his cases.

According to Dery, he is unsure he will receive a fair trial if Justice Torkonoo sits on his cases. “Justice Gertrude Torkonoo has exhibited or demonstrated a real likelihood of bias in the handling of his cases,” his petition noted.

In his petition dated January 21, 2016 Justice Dery further noted that Justice Torkunoo further stated that: “…your Ladyship, Justice Torkonoo J.A in her affidavit in opposition to an application for contempt I filed at the Supreme Court exhibited bias against me. She deposed in several paragraphs of her affidavit that I take steps to restore the dignity of the court and administration of justice from the barrage of untruths and unwarranted applications.”

“Your Ladyship, the assessment of the credibility of a witness is part of the judicial process. Her Ladyship Justice Gertrude Torkonoo J.A has already assessed me as an untruthful person. It stands to reason with respect, your Ladyship, that her impartiality in handling any of my suits is very much in doubt,” he added.

He has therefore prayed the court and the Chief Justice to “in the overall interest of justice you use your powers to remove Her Ladyship Justice Gertrude Torkonoo J.A from my cases and replace her with a different judge.”

Anas Aremeyaw Anas and his TigerEye PI brought petitions for the removal of 12 High Court judges and 22 lower court judges upon two years of investigations against them.
