The five member Supreme Court Panel has unanimously dismissed Justice Paul Dery’s suit seeking to annul the processes adopted by the Chief Justice for his removal from office.
Justice Dery and several other judges are facing sanctions for allegedly taking bribes, according to an investigation by investigative journalist, Anas Aremeyaw Anas and his Tiger Eye PI team.
The court gave the following reasons for dismissing Dery’s suit: “according to the seven member panel of justices, despite some breach of the confidentiality clause by the petitioner for the removal of superior court justices, an annulment of the entire impeachment process is not a remedy to the case. Their ruling also indicated that they did not believe the Chief Justice could not be said to have erred as she had given the applicant an opportunity to prove his innocence as the committee to investigate the matter will not make a decision based on public opinion.”

The Supreme court also said “the state and the people of Ghana have a right to demand that judges live above suspicion”.
The court also failed to grant Justice Dery’s suit of perpetual injunction. The court said that will stifle free speech.
