A 37-year-old man who allegedly infected his boyfriend with HIV is currently facing trial, in Auckland District Court, for his criminal act.

Mr Mikio Filitonga is defending charges of causing grievous bodily harm with reckless disregard and committing a criminal offence by doing an unlawful act.

The prosecutor argues that Mr Filitonga knowingly infected his unnamed partner with HIV after he lied to him that he was fine, to mean he was not HIV positive.

“Filitonga who himself knew he was positive after a test in May 2013 and fully aware of his obligation to disclose his health status to his partner, deliberately had unprotected intercourse with his boyfriend,” the prosecutor alleged.

The plaintiff, who was himself HIV negative at the time, says he was pleased to hear that his partner was ‘fine’. It therefore came as a shocker to him when he later learnt that he had been infected, which explains why he sued his partner.
