Julio De Medeiros, the legal counsel for the Marwako supervisor Jihaad Chaaban, has expressed disappointment in the turn of events leading to the judge’s ruling.
According to him, they assumed initially that the judge would accept their out of court settlement with the victim.
It should be recalled that the Marwako supervisor was arrested some months ago for assaulting one of his employees, by raining insults on her and then dipping her face in pepper sauce.
The incident sparked public outrage as the it became the trending topic on social media, with many calling for the boycott of the restaurant and its services.
Evelyn Boakye, the lady at the centre of the Marwako ‘pepper’ assault was reportedly admitted at the psychiatric department of the Korle-Bu Teaching Hospital for a clinical and psychological care.
After weeks of court deliberations, the judge presiding over the case, Victoria Ghansah, sentenced the supervisor to nine months in prison for offensive conduct and six months for causing harm and assault. Both sentences will be run concurrently.
The judge in her address said the out of court settlement was rejected because the case was a criminal one and not a civil matter.
She noted prosecution’s ability to prove beyond doubt that the defendant had indeed committed offense.
According to a Citi FM report, Marwarko supervisor's lawyer stated that they disagreed with the judges ruling, as they thought their defense of the case was worthy of a better settlement.
He noted that the previous investigator of the matter had said the incident was accident but it seemed the presiding judge thought otherwise.
Nevertheless, the counsel for Jihaad upon instructions from their client are set to file an appeal to his sentence.
Meanwhile, the victim has said she is satisfied with the judges ruling as justice has been served.
